The Kuching High Court has ended a nearly three-year drug case without calling the five accused to enter their defence. At the close of the prosecution’s case on Sept 3, the judge ruled that evidence from 15 witnesses had not established a prima facie case. All five were discharged and acquitted. The charge alleged that the group, acting with common intention, trafficked 42.2kg of methamphetamine at a hotel near Jalan Nanas at about 12.30pm on Oct 12, 2023. It was brought under Section 39B(1)(a) of the Dangerous Drugs Act 1952, read with Section 34 of the Penal Code. Because the court stopped the case at the prosecution stage, the five were never required to answer the allegation. The Sept 3 ruling is an acquittal, not a release after serving a sentence; no further step by the prosecution was stated.

A 37-year-old man was remanded after police found 6.1 grammes of suspected methamphetamine in Kampung Bako Hulu, Kuching. Police said the suspected drugs were packed in 16 plastic packets and were worth an estimated RM305. His preliminary urine test was negative and police said he had no previous criminal record. He was remanded for four days until Aug 17 while the case is investigated under Section 39A(1) of the Dangerous Drugs Act 1952. If convicted, he faces up to five years in prison and whipping of up to nine strokes. Kuching police said the case happened along Jalan Setia Raja on Tuesday, July 7, 2026, during an integrated operation involving traffic police and the Narcotics Criminal Investigation Division. What police found Kuching police chief ACP Alexson Naga Chabu said officers found three transparent packets containing compressed dried leaves believed to be cannabis in a brown sling bag carried by the 20-year-old driver. The items weighed about 17.50g in total. Police said the driver also tested positive for THC in a urine screening. Investigation ongoing The man was arrested under Section 6 of the Dangerous Drugs Act 1952. The Magistrates' Court granted a four-day remand from July 8 to July 11. Police said 60 people and 55 vehicles were checked in the operation. A total of 16 summonses were also issued for traffic offences.
